Bluedog Consents to Stop Selling Alleged Patent-Infringing Toner Cartridges

Canon Inc. of Tokyo, Japan, today announced that it’s concluded its patent-infringement lawsuit against Bluedog Distribution Inc. in the U.S. District Court for the Southern District of Florida, concerning certain third-party, non-OEM Bluedog toner cartridges sold for use in Canon and HP laser printers.

To resolve the lawsuit, Bluedog stipulated to a consent judgment and permanent injunction from the Southern District of Florida, which prohibits Bluedog from making, using, selling, and offering for sale in the United States, and from importing into the United States, the toner cartridges that Canon accused of infringing upon its U.S. Patent Nos. 9,746,826, 9,836,021, 9,841,727, 9,841,728, 9,841,729, 9,857,764, 9,857,765, 9,869,960 and 9,874,846.

On February 28th, Canon Inc., Canon U.S.A. of Melville, New York, and Canon Virginia of Newport News, Virginia, submitted a patent-infringement complaint to the U.S. International Trade Commission (ITC) and requested that the ITC issue a general exclusion order and cease-and-desist orders against some  50 companies, including Bluedog Distribution of Hollywood, Florida, alleging that the toner cartridges and imaging drums being sold by the companies, which are  based in China,  Hong Kong, Macau, Canada, and the United States, violate Canon patents.
