Canon Announces Latest Toner Take-Downs

Earlier this month, Canon Inc. of Tokyo, Japan, announced that a number of unauthorized toner cartridges have been removed from the Amazon ecommerce website at its request.

Smart Gadget USA

On February 10th, Canon announced: It had filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Smart Gadget USA for use with HP laser printers.

Canon’s infringement report alleged that certain model HP 130A toner cartridges sold by Smart Gadget USA via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Smart Gadget USA’s listings for those products, namely, Smart Gadget USA’s listings with Amazon Standard Identification Numbers (“ASINs”) B00NBDOJ1Y, B00NBDONTW, B00NBDOMDY, B00NBDOLGC, B00NBDOK9U and B00NBDOHR0.

At the time of Canon’s announcement, the Smart Gadget USA listings were no longer available on Amazon.com.

Triple Best

Canon announced it had filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by TRIPLE BEST for use with HP laser  printers.

Canon’s infringement report alleged that certain model HP CF350A toner cartridges sold by TRIPLE BEST via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove TRIPLE BEST’s listings for those products, namely, TRIPLE BEST’s listings with Amazon Standard Identification Numbers (“ASIN”) B07995CDGK and B07YN7P7DM.

At the time of this announcement, the TRIPLE BEST listings were no longer available on Amazon.com.

Forlei

Canon announced it had filed an infringement report with Amazon.ca seeking removal of an Amazon.ca listing for certain toner cartridges sold by Forlei.

Canon’s infringement report alleged that certain model CC530A, CC531A, CC532A and CC533A toner cartridges sold by Forlei via Amazon.ca infringed Canon’s Canadian Patent no. 2,635,791. Canon requested the removal of the corresponding listings for these products, having Amazon Standard Identification Numbers B074RZ2RYF and B074RZ3L4C.

At the time of this announcement, products sold under these listings were no longer available on Amazon.ca.

Ecshub

Canon announced it had filed an infringement report with Amazon.ca seeking removal of an Amazon.ca listing for certain toner cartridges sold by Ecshub.

Canon’s infringement report alleged that certain model CB540A, CB541A, CB542A and CB543A toner cartridges sold by Ecshub via Amazon.ca infringed Canon’s Canadian Patent no. 2,635,791. Canon requested the removal of the corresponding listings for these products, having Amazon Standard Identification Numbers B07PPPGXFF, B07PQSWWRK, B07PML64HR, B07PPPDV4G and B07PRYM8YJ.

At the time of this announcement, products sold under the listings were no longer available on Amazon.ca.

zhongshancaipin

Canon announced it had filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by zhongshancaipin for use with HP laser printers.

Canon’s infringement report alleged that certain model CF360A, CF361A, CF362A and CF363A toner cartridges sold by zhongshancaipin via Amazon.com infringed Canon’s U.S. Patent No. 9,581,958. Canon requested that Amazon remove zhongshancaipin’s listings for those products, namely, zhongshancaipin’s listings with Amazon Standard Identification Numbers (“ASINs”) B07ZY5KKCL, B07ZY5QRB3, B07ZY61SBV, B07ZY5WK6G, B07ZY6CHXK, B07ZY61H38, B07ZY6FP4B, B07ZY5SLH7 and B07ZY66H6N.

At the time of this announcement, the zhongshancaipin listings were no longer available on Amazon.com.

In all of these Amazon cases, Canon noted that filing an infringement report with Amazon.ca is a service offered by Amazon and does not constitute an official finding of infringement. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon.

Bublat GmbH & Co. KG Settlement

Canon also announced that it had signed a settlement agreement with Bublat GmbH & Co. KG and its managing directors in order to resolve their patent dispute regarding Canon’s European Patent EP 1 977 289 B1 (“EP ‘289”). The matter at issue concerns the offering and distribution of certain laser toner cartridges by Bublat GmbH & Co. KG, via, for example, on www.amazon.de and www.druckerpatronenexpress.de.

The settlement agreement includes a Europe-wide cease-and-desist declaration, whereupon Bublat GmbH & Co. KG and its managing directors are prohibited from making, offering, putting into circulation and/or importing and/or possessing certain laser toner cartridges that infringe claim 1 and 2 of EP ‘289 in all countries where EP 1 977 ‘289 B1 is valid and in force.

The cartridges at issue include a developing unit moveable relative to the drum unit when receiving force via a force receiving device. The respective cartridges can replace the OEM toner-cartridge models HP CE320A, HP CE322A and HP CE323A, which are compatible with HP laser  printers. Furthermore, Bublat GmbH & Co. KG as well as its managing directors have agreed to pay damages for past infringement to Canon. Further details of the settlement agreement are confidential.
