Canon Starts New Year with Amazon Toner Take-Downs

On January 7th, Canon Inc. of Tokyo, Japan, announced that Amazon had taken down a number of unauthorized toner cartridges that Canon says infringe on its patents:

SIA “Solution”

Canon announced  it had filed Report Infringement Forms with Amazon.de, and Amazon.es based on the alleged use of claims 1 and 2 of the Germany, and Spanish portions of Canon’s European Patent EP 1 977 289 (“EP ‘289”) regarding certain toner cartridges offered by SIA “Solution” under the following ASINs (Amazon Standard Identification Numbers).

Afterwards, Amazon took down the toner cartridges. These products are compatible with HP toner-cartridge models and provide inter alia a non-OEM housing and a non-OEM force receiving device according to claim 1 of EP ‘289. Furthermore, they comprise an elastic portion according to claim 2 of EP ‘289.

M&F Shop

Canon announced it had filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by M&F Shop for use in HP laser beam printers.

Canon’s infringement report alleged that certain model CE310A, CE311A, CE312A and CE313A toner cartridges sold by M&F Shop via Amazon.com infringed on Canon’s U.S. Patent No. 8,688,008.

Canon requested that Amazon remove M&F Shop’s listings for those products, namely, M&F Shop’s listings with Amazon Standard Identification Numbers (“ASINs”) B01GDRZLI4, B01GDS9D3C, B01GDSAI2W, B01GDRXXWA, B01GDS63P8, B01GDS8JN2, B01GDS4OX6, B01GDSC90Q, B01GDS9W38, B01GDSB1YQ, B01GDS2DBQ and B01GDSCXWK.

At the time of this announcement, the above-identified M&F Shop’s listings were no longer available on Amazon.com.

Hehua Store

Canon filed  an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Hehua Store for use in HP laser beam printers.

Canon’s infringement report alleged that certain model CE310A, CE311A, CE312A and CE313A toner cartridges sold by Hehua Store via Amazon.com infringed on Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Hehua Store’s listings for those products, namely, Hehua Store’s listings with Amazon Standard Identification Numbers (“ASINs”) B07D4DZ7MM, B07D4F2YQG, B07D4F7XBC, B07D4F6W17, and B07D4DNZM6.

At the time of this announcement, the above-identified Hehua Store’s listings were no longer available on Amazon.com.

Canon noted that filing a Report Infringement Form with Amazon is a service offered by Amazon and doesn’t comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon. Amazon informed the vendors about the take-downs and the vendors may object.
