Canon Obtains More Toner-Cartridge Takedowns

Canon Inc. of Tokyo, Japan, is continuing in its strategy to have third-party unauthorized allegedly patent-infringing toner cartridges removed from the marketplace by filing infringement reports with Amazon – a process that’s likely considerably less expensive than litigation.

On December 16th, it announced iAmazon had removed three brands:

JUNBS

Canon filed  an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by JUNBS for use in HP laser printers.

Canon’s infringement report alleged that certain model CF258A toner cartridges sold by JUNBS via Amazon.com infringed on Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; and 8,688,008. Canon requested that Amazon remove JUNBS’s listings for those products, namely, JUNBS’s listings with Amazon Standard Identification Numbers (“ASINs”) B07YFG1BGL, B07ZTPCFSS and B07YFDW448.

At the time of this announcement, the JUNBS listings were no longer available on Amazon.com.

Mal-ll

Canon filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Mal-ll for use in HP laser printers.

Canon’s infringement report alleged that certain model CF258A toner cartridges sold by Mal-ll via Amazon.com infringed on Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; and 8,688,008. Canon requested that Amazon remove Mal-ll’s listings for those products, namely, Mal-ll’s listings with Amazon Standard Identification Numbers (“ASINs”) B07XYL5HTN, B07ZBHVHKX, B07Z259CG1 and B07Z86NJ96.

At the time of this announcement, the Mal-ll listings were no longer available on Amazon.com.

Sprint Toner

Canon filed an infringement report with Amazon.ca seeking removal of an Amazon.ca listing for certain toner cartridges sold by Sprint Toner.

Canon’s infringement report alleged that certain model CC530A, CC531A, CC532A, CC533A, CE410X, CE410A, CE411A, CE412A, CE413A, CF380X, CF380X, CF381A, CF382A and CF383A toner cartridges sold by Sprint Toner via Amazon.ca infringed on Canon’s Canadian Patent no. 2,635,791. Canon requested the removal of the corresponding listings for these products, having Amazon Standard Identification Numbers B009E9GA3O, B00QESPHDW, B013YSIAQ0, B00PHRXAXU and B01AOIM4GA.

At the time of this announcement, products sold under the above identified listings were no longer available on Amazon.ca.

Canon noted that filing an infringement report with Amazon.ca is a service offered by Amazon and does not constitute an official finding of infringement. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon.
