Canon Announces Slew of Toner-Cartridge Infringement Actions

This week, Canon Inc. of Tokyo, Japan, announced a slew of actions designed to remove from the marketplace third-party toner cartridges designed for use with HP laser printers.

Craig Maleedy

On November 21st, Canon announced that it and Craig Maleedy, doing business as “cartrite.co.uk,” agreed to resolve their pending patent dispute by signing a settlement agreement.

Craig Maleedy accepted a preliminary injunction (docket no. 4a O 9/19) issued by the District Court Düsseldorf  in Germany based on the infringement of the German portion of Canon’s European Patent EP 2 087 407 B1 as final and binding between the parties. Craig Maleedy agreed to refrain from making, offering, putting into circulation and/or importing and/or possessing laser toner cartridges comprising a drum unit with a certain coupling member for use in various models of HP and/or Canon laser beam printers in all countries where EP 2 087 407 B1 is valid and in force. Further details of the settlement agreement are confidential.

Druck Quality SL

On November 21st, Canon announced that the District Court Düsseldorf granted a preliminary injunction against Druck Quality SL, trading as “Konver,” as well as against its managing director.

The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a drum unit and a process cartridge. Canon noted that the preliminary injunction is not final and can be appealed, and directs Druck Quality SL to stop selling  and distributing laser toner cartridges comprising a drum unit with a certain coupling member, e.g. via www.amazon.de. The infringing cartridges can replace the OEM cartridge models HP CE505A and HP CF280A, which are compatible with HP laser printers.

Office Partner

On November 21st, Canon announced that the District Court Düsseldorf granted a preliminary injunction against Office Partner GmbH as well as against its managing directors.

The decision has already been served on the defendants. The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 1 977 289 B1 relating to a process cartridge. The preliminary injunction, which can be appealed, directs Office Partner GmbH and its managing directors to stop selling and distributing certain laser toner cartridges via the www.amazon.de ecommerce website.

The infringing embodiment includes a developing unit moveable relative to the drum unit when receiving force via a force receiving device. The cartridges at issue can replace the OEM cartridge models HP CC530A, HP CC531A, HP CC532A, HP CC533A, HP CE410X, HP CE411A, HP CE412A and HP CE413A which are compatible with HP laser  printers. Furthermore, as the preliminary injunction contains a claim for sequestration, the infringing cartridges must be handed over to a bailiff until the matter is finally solved.

CRBH-UC 

On November 20th, Canon announced it had filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by CRBH-UC for use in HP laser printers.

Canon’s infringement report alleged that certain model CF258A toner cartridges sold by CRBH-UC via Amazon.com infringed Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; and 8,688,008. Canon requested that Amazon remove CRBH-UC’s listings for those products, namely, CRBH-UC’s listings with Amazon Standard Identification Number (“ASIN”) B07WK9J3BL.

At the time of this announcement, the CRBH-UC listing was no longer available on Amazon.com.

HEHAIRIYONGPIN

On November 20th, Canon announced it filed an infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by HEHAIRIYONGPIN for use in HP laser printers.

Canon’s infringement report alleged that certain model CF258A toner cartridges sold by HEHAIRIYONGPIN via Amazon.com infringed Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; and 8,688,008. Canon requested that Amazon remove HEHAIRIYONGPIN’s listings for those products, namely, HEHAIRIYONGPIN’s listings with Amazon Standard Identification Number (“ASIN”) B07VTP6KK3.

At the time of this announcement, the HEHAIRIYONGPIN listing was no longer available on Amazon.com.

Lucky Suppliers

On November 20th, Canon  announced that the District Court Düsseldorf granted it a preliminary injunction against Lucky Suppliers Handels GmbH, trading as “Lucky Suppliers,”,as well as against its managing directors.

Lucky Suppliers Handels GmbH and its managing directors accepted the preliminary injunction as final and binding by signing a final declaration. The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 1 977 289 B1 relating to a process cartridge and directs Lucky Suppliers Handels GmbH to stop selling and distributing certain laser toner cartridges on www.amazon.de.
