Canon Asks Amazon to Remove Multiple Aftermarket Toner Cartridges

Fresh off a key patent-infringement defeat at the hands of the U.S. International Trade Commission (see here), Canon Inc. of Tokyo, Japan, bounced back, reporting on March 15th that it’s requested Amazon to remove four brands of aftermarket toner cartridges designed for use with HP laser printers:

SuperInkToner

Canon filed a Report Infringement Forms with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by SuperInkToner for use in HP laser  printers.

Canon’s Report Infringement Forms alleged that certain model CE505A toner cartridges sold by SuperInkToner via Amazon.com infringed on Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; 8,688,008; and 8,676,090. Canon requested that Amazon remove SuperInkToner’s listings for those products, namely, SuperInkToner’s listings with Amazon Standard Identification Numbers (“ASINs”) B07KZYY8QH, B07KZZQKZ8, B07KZYG13V , B07KZXHJKW, B07KZX8QN6, B07KZWD7JP, B07KZHPG4M, B07JVWLKYZ, B07F8WZ9PV, B07F8TL6ZK, B07F8TB5RG, B07F8T6T53, B07F8RCWSH, B07F8R2T4T and B07F8Q836J.

At the time of this announcement, the SuperInkToner listings were no longer available on Amazon.com.

Carlos Imaging

Canon filed a Report Infringement Forms with Amazon.com seeking removal of Amazon.com listings toner cartridges sold by Carlos Imaging for use in HP laser printers.

Canon’s Report Infringement Forms alleged that certain model CF226A toner cartridges sold by Carlos Imaging via Amazon.com infringed Canon’s U.S. Patent Nos. 8,280,278; 8,630,564; 8,682,215; 8,688,008; and 8,676,090. Canon requested that Amazon remove Carlos Imaging’s listings for those products, namely, Carlos Imaging’ listings with Amazon Standard Identification Numbers (“ASIN”) B01BKWK00G, B01BKWK0TC, B01BKWJZM0 and B01BKWK0EC.

At the time of this announcement, the Carlos Imaging listings were no longer available on Amazon.com.

N&J Inkjet

Canon filed a Report Infringement Form with Amazon UK-based on the alleged use of claim 1 and 25 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505A” and “CF280A”offered by N&J Inkjet Ltd. under the ASINs (Amazon Standard Identification Numbers) B00MWV68TC and B00MWV75X0.

Afterwards, Amazon took down the respective products. These products are compatible with the OEM HP toner-cartridge models CE505A and CF280A and provide inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Anverkauf

Canon filed a Report Infringement Form with Amazon UK-based on the alleged use of claim 1 and 25 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Anverkauf Einzelunternehmen under the ASIN (Amazon Standard Identification Number) B01FO0EIUS. Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model CE505X and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Canon noted that filing a Report Infringement Form with Amazon is a service offered by Amazon and does not comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon.

Amazon informed the vendors about the take-down requests and the vendors may object to it.
