Canon Requests Amazon to Remove More Clone Toner Cartridges

Canon Inc. of Tokyo, Japan, today announced that it filed three infringement reports with Amazon.com seeking removal of Amazon.com listings for clone toner cartridges for use in HP laser printers,

Canon requested Amazon remove toner cartridges sold by Carlos Imaging for use in HP laser printers. Canon’s infringement report alleged that certain model HP 126A toner cartridges sold by Carlos Imaging via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Carlos Imaging’ listings for those products, namely, Carlos Imaging’ listings with Amazon Standard Identification Number (ASIN) B06Y43DYHV.

At the time of this announcement, the above-identified Carlos Imaging listings were no longer available on Amazon.com.

Canon also filed a Report Infringement Form with Amazon.es based on the alleged use of claim 1 and 25 of the Spanish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model CF226X offered by Maria Carmen García Fornet under the ASIN (Amazon Standard Identification Number) B01GG565RO. Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model CF226X and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Last Canon filed a Report Infringement Form with Amazon.es based on the alleged use of claim 1 and 25 of the Spanish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model CF226X offered by GOLDAN COLOR S.L.U. under the ASIN (Amazon Standard Identification Number) B01GG565RO. Afterwards, Amazon took down the respective product. This product is compatible with the OEM HP cartridge model CF226X and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Canon noted that filing a Report Infringement Form with Amazon is a service offered by Amazon and does not comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon. Amazon informed the vendors about the take-downs and the vendors may object to it.
