Canon Announces More Amazon Toner Take-Downs, New Injunction

Canon Inc. of Tokyo, Japan, continues to request Amazon to remove third-party clone toner cartridges used with HP laser printers. Canon also announced that it had obtained a preliminary injunction against a clone toner-cartridge maker in Germany.

Today, Canon announced that it had taken these actions:

  • Filed a Report Infringement Form with Amazon UK-based on the alleged use of claim 1 and 25 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Home Media Online Composite Containers Ltd. under the ASIN (Amazon Standard Identification Number) B00BOS4R92. Afterwards, Amazon took down the toner cartridge. The toner cartridge is compatible with the HP toner-cartridge model CE505X and provides inter alia a non-OEM coupling member, a non-OEM drum, as well as a non-OEM housing.
  • Filed  a Report Infringement Form with Amazon UK-based on the alleged use of claim 1 and 25 of the UK portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Techtopium Taiwan Ecolink International Co. Ltd. under the ASIN (Amazon Standard Identification Number) B07F27BRXG. Afterwards, Amazon took down the toner cartridge. The toner cartridge is compatible with the OEM HP cartridge model CE505X and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Canon noted that filing a Report Infringement Form with Amazon is a service offered by Amazon and does not comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon.

Amazon informed the vendors about the takedown requests and the vendor may object to it.

Preliminary Injunction

Canon also announced today that the District Court Düsseldorf in Germany granted a preliminary injunction against Idem Rebuilding Di Carbonara Giuseppe, trading as “Universocartuccia.”

The preliminary injunction is based on the infringement of the German portion of Canon’s European patent EP 2 087 407 relating to a toner-cartridge drum unit and a process cartridge. The preliminary injunction, which is not final and can be appealed, enjoins Idem Rebuilding Di Carbonara Giuseppe from offering and distributing laser toner cartridges comprising a drum unit with a certain coupling member, e.g. via www.amazon.de. The infringing cartridges can replace the OEM cartridge models HP CE505A, HP CE505X, HP CF280A and HP CF280X, which are compatible with HP beam printers.
