Canon Gets Amazon to Remove More Clone Toner Cartridges (Updated)

On November 22nd,  Canon Inc. of Tokyo, Japan, continued to persuade Amazon to remove more third-party “clone” toner cartridges, announcing  that it  had filed three Report Infringement Forms with Amazon.es petitioning Amazon to remove three third-party toner cartridges sold by three companies based in Spain.

Canon filed a report based on the alleged use of claim 1 and 25 of the Spanish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by GOLDAN COLOR S.L.U. under the ASIN (Amazon Standard Identification Number) B01GFZJ78E. Afterwards, Amazon took down the respective products. These products are compatible with the HP toner-cartridge model CE505X and provide inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Canon also announced it had filed a Report Infringement Form with Amazon.es based on the alleged use of claim 1 and 25 of the Spanish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505A” and “CE505X” offered by DRUCK QUALITY SL under the ASINs (Amazon Standard Identification Number) B01HO4AXWO and B01272GSJ0. Afterwards, Amazon took down the respective products. These products are compatible with the HP toner-cartridge model CE505A, CE505X and provide inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Last, Canon filed a Report Infringement Form with Amazon.es based on the alleged use of claim 1 and 25 of the Spanish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by CARLOS MARTINEZ GONZALEZ under the ASIN (Amazon Standard Identification Number) B00GJWWKYM. Afterwards, Amazon took down the respective products. These products are compatible with HP toner-cartridge model CE505X and provide inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

Canon noted that filing a Report Infringement Form with Amazon is a service offered by Amazon and does not comprise any official finding of validity or infringement of a patent. The decision to take down a product is in the discretion of Amazon and is based on information provided by Canon. Amazon informed the vendor about the takedown and the vendor may object to it.

On November 27th, Canon also announced that  Amazon has removed for sale two more clone toner cartridges. Canon first filed a Report Infringement Form with Amazon ES based on the alleged use of claim 1 and 25 of the Spanish portion of Canon’s European Patent EP 2 087 407 regarding the cartridge model “CE505X” offered by Neotronics Europe SL under the ASIN (Amazon Standard Identification Number) B07DRMB86H. Afterwards, Amazon took down the respective product. This product is compatible with HP toner-cartridge model CE505X and provides inter alia a non-OEM coupling member, a non-OEM drum as well as a non-OEM housing.

On November 27th, Canon further announced that it had filedan infringement report with Amazon.com seeking removal of Amazon.com listings for certain toner cartridges sold by Vision Supplies for use in HP laser printers.

Canon’s infringement report alleged that certain model HP 126A toner cartridges sold by Vision Supplies via Amazon.com infringed Canon’s U.S. Patent No. 8,688,008. Canon requested that Amazon remove Vision Supplies’ listings for those products, namely, Vision Supplies’ listings with Amazon Standard Identification Numbers (“ASINs”) B00ARLFYSU, B00ARLFZBQ, B00ARLFY9Y, B00ARLG08S, B00ARLG1C8, B00ARLFWNM, B00ARLG0O2, B00ARLFZSY, B00ARLFXAY and B00ARLFXQI. At the time of this announcement, Canon says that the Vision Supplies listings were no longer available on Amazon.com.
